These Terms and Conditions («Terms») govern your use of the Ñami Ñami Bakery website, online ordering platforms, and all products and services offered (the “Services”). By placing an order, accessing the website, or otherwise interacting with Ñami Ñami Bakery, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use our Services.

1. Website usage and eligibility

To place an order, you must be at least 18 years old. You agree not to misuse the website, interfere with its operation, submit fraudulent orders, or violate any applicable laws. Ñami Ñami Bakery reserves the right to refuse service, cancel orders, or terminate accounts in the event of any misuse or suspected fraud.

2. Product information, variations, and custom orders

All products are handcrafted, so slight variations in color, decoration, height, design, and final appearance may occur. Custom orders are interpreted artistically. When a customer provides a reference image, the final product will be made in Ñami Ñami Bakery's own style and is not guaranteed to be an exact replica.

3. Prices, payments and order confirmation

Prices are expressed in US dollars and are subject to change without notice. An order is considered confirmed only when payment is successfully processed and Ñami Ñami Bakery confirms receipt of the order.

Custom cakes require a non-refundable deposit of 70%, except within the first 12 hours after payment. The remaining balance of 30% must be paid before collection or delivery. Orders placed less than 24 hours in advance require prepayment of 100% and are non-refundable.

4. Shipping, collection and delivery

Delivery times are estimates and may vary due to weather conditions, traffic, or issues related to the courier service. The customer is responsible for providing accurate delivery information. Ñami Ñami Bakery is not responsible for delays resulting from incorrect addresses or the customer's absence.

Once the product is delivered to the customer or designated person, the customer assumes full responsibility for the proper handling, transportation, storage, and consumption of the product.

5. Responsibility regarding allergies

Customers must inform Ñami Ñami Bakery of any allergies or dietary restrictions before placing an order. Failure to provide this information releases Ñami Ñami Bakery from any liability, including for adverse reactions, medical emergencies, or damages.

Products may contain or have been exposed to nuts, dairy, egg, soy, wheat or gluten, coconut, food coloring, or other allergens. Cross-contamination is always possible in a bakery environment.

6. Limitation of liability

To the maximum extent permitted by United States law, Ñami Ñami Bakery will not be liable for damages arising from improper handling, transportation, or storage of the product, failure to disclose allergies, or misuse of the product. Products are provided “as is,” without warranties beyond those required by law. In no event will Ñami Ñami Bakery be liable for indirect, incidental, or consequential damages.

7. Refunds, cancellations and order modifications

All rules relating to refunds and cancellations are governed by the official Refund Policy described in the relevant section of this document.

8. Intellectual Property

All brand assets, logos, product photographs, text, and website content are the property of Ñami Ñami Bakery. Their reproduction or unauthorized use is prohibited.

9. Applicable legislation

These Terms are governed exclusively by the laws of the state in which Ñami Ñami Bakery operates. Any dispute will be resolved through binding arbitration or in small claims court, unless otherwise provided by law.

10. Changes to the Terms

Ñami Ñami Bakery may update these Terms at any time. Continued use of the Services constitutes acceptance of the updated Terms.
